A therapist–client relationship is only established after:

  1. an initial intake has been completed,

  2. informed consent and required practice documents have been executed, and

  3. services have been formally scheduled and accepted by Alive and Whole Wellness PLLC.

This website does not provide emergency or crisis services. If you are experiencing a mental health emergency, emotional crisis, or are considering harming yourself or others, please call 911 or seek immediate assistance from a local emergency provider.

While Alive and Whole Wellness PLLC strives to keep the information on this website accurate and current, we make no warranties or representations regarding the completeness, reliability, or accuracy of any content.

Submitting a form, sending an email, or leaving a voicemail does not establish a professional relationship.

NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL AND MENTAL HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Our Responsibilities

Alive and Whole Wellness, PLLC is required by law to:

  • maintain the privacy of your protected health information (“PHI”),

  • provide you with this Notice of our legal duties and privacy practices, and

  • follow the terms of this Notice.

2. How We May Use and Disclose Your Information

We may use and disclose your PHI for the following purposes:

a. Treatment

To provide, coordinate, or manage your mental health care and related services, including animal-assisted therapy services.

b. Payment

To obtain payment for services provided to you.

c. Health Care Operations

For practice operations, quality assurance, training, and administrative activities.

3. Other Permitted and Required Disclosures

We may disclose your information as required by law, including:

  • to comply with legal proceedings,

  • for public health activities,

  • for reporting abuse, neglect, or domestic violence when required by law,

  • to prevent a serious and imminent threat to health or safety.

4. Uses and Disclosures Requiring Your Authorization

Other uses and disclosures of your PHI not described in this Notice will be made only with your written authorization, unless otherwise permitted or required by law.

You may revoke your authorization in writing at any time, except to the extent we have already relied on it.

5. Your Rights

You have the right to:

  • inspect and obtain a copy of your records,

  • request corrections to your records,

  • request restrictions on certain uses or disclosures,

  • request confidential communications,

  • receive a copy of this Notice, and

  • receive an accounting of certain disclosures.

6. Special Rules for Minors and Parents

Alive and Whole Wellness, PLLC provides counseling services to minors. Alive and Whole Wellness, PLLC strongly encourages parents and guardians to discuss confidentiality expectations and information-sharing practices with the treating clinician at the start of services.

In general, a parent or legal guardian is treated as the minor client’s personal representative and may have the right to access the minor’s protected health information.

However, under Texas law and applicable federal privacy rules, there are important exceptions.

Alive and Whole Wellness, PLLC may limit a parent’s or guardian’s access to a minor’s records when:

  • the minor is legally permitted to consent to their own mental health treatment without parental consent, or

  • the information relates to services for which the minor has legal confidentiality rights, or

  • providing access would, in the professional judgment of the treating clinician, be reasonably likely to cause substantial harm to the minor or another person.

In those situations, Alive and Whole Wellness, PLLC may deny or restrict access to certain records as permitted by law.

7. Access to a Minor’s Records

A parent or legal guardian generally has the right to inspect or obtain a copy of a minor client’s records.

However, access may be restricted when:

  • the minor consented to treatment independently,

  • the records consist of psychotherapy notes, or

  • the clinician determines that disclosure would not be in the best interest of the minor or could result in harm.

Requests for access to a minor’s records will be reviewed on a case-by-case basis in accordance with applicable law and professional standards.

8. Confidential Communications With Minor Clients

Alive and Whole Wellness, PLLC, may maintain certain communications and clinical information as confidential between the clinician and the minor client, as permitted by law.

This may include information discussed during therapy sessions that is clinically sensitive and not appropriate for disclosure to a parent or guardian without the minor’s consent or without clinical necessity.

9. Divorced or Separated Parents and Custody of Minor Clients

Unless Alive and Whole Wellness, PLLC, receives a valid court order, custody order, or other legally binding documentation limiting access, both parents may be treated as having the same rights to access a minor client’s records.

Alive and Whole Wellness, PLLC does not determine legal custody rights and relies on documentation provided by the parents or guardians.

10. Our Use of Electronic Communication

We may communicate with you by phone, email, or other electronic means regarding scheduling and administrative matters. Electronic communications carry certain risks, which will be discussed during your intake process.

11. Complaints

If you believe your privacy rights have been violated, you may file a complaint with Alive and Whole Wellness, PLLC or with the U.S. Department of Health and Human Services.

You will not be retaliated against for filing a complaint.

12. Changes to This Notice

Alive and Whole Wellness, PLLC reserves the right to change this Notice. Any revised Notice will apply to all PHI we maintain and will be made available upon request and on our website.
